1. Services
- We provide seasonal porch decorating, including delivery, arrangement, and optional removal services.
- Package contents may vary based on availability; substitutions of equal or greater quality and value may occur.
- We will make reasonable attempts to contact you prior to arrival for installation.
2. Payment
- Invoices are issued through Zoho Books.
- Payment is due before or at the time of installation.
- Accepted payment methods: any listed on your invoice (credit card, ACH, etc.).
- Late payments (payments not received within 48 hours of installation) are subject to a 10% late fee.
- Unpaid balances over 30 days may be sent to collections, and you will be responsible for all collection costs and legal fees.
3. Scheduling & Access
- Installations occur during your scheduled delivery window.
- You must provide safe, unobstructed access to the installation area.
- If access is denied or no one is available during the scheduled window, we will attempt to reschedule once at no additional charge.
- If access is denied a second time or you are unavailable for the rescheduled appointment, the order will be cancelled and a 75% refund may be issued at our discretion, with a 25% restocking and service fee retained.
4. Cancellations & Refunds
- Cancellation requests must be submitted in writing via email.
- Cancel 7+ days before selected installation week → full refund minus credit card processing fees (typically 3%).
- Cancel within 7 days of selected installation week → 50% refund at Company's discretion.
- No refunds once installation is complete.
5. Ownership & Condition
- If removal service is NOT purchased: All décor becomes your property upon installation, and you may keep, discard, or dispose of items as you wish.
- If removal service IS purchased: We will return during your scheduled removal week to collect the décor. Please leave items in place so we can retrieve them. If you prefer to keep any items or no longer need removal service, simply let us know.
- We are not responsible for natural deterioration, pests, animals, theft, vandalism, or weather damage after installation.
6. Liability & Property Damage
- Client assumes full responsibility for décor once installed.
- We are not liable for accidents, injuries, or damages to persons or property related to the décor after installation.
- While we take care during installation, décor is placed on Client's property with their permission. We are not liable for any damage to property, surfaces, paint, siding, landscaping, fixtures, or other items, whether direct or incidental.
- Client agrees to inspect the property immediately after installation and report any concerns within 24 hours via email or phone.
7. Weather & Force Majeure
- Severe weather, natural disasters, or other events beyond our control may require rescheduling of installation or removal.
- We are not liable for damage caused by weather, animals, theft, vandalism, or other events beyond our control after installation is complete.
8. Photography & Marketing
- With your consent (collected during the ordering process), we may photograph your installation for marketing purposes including social media, website, and promotional materials.
- You may revoke photo consent at any time by emailing us at [your email], and we will remove photos featuring your property within 30 days.
9. Privacy & Data Collection
- We automatically log IP addresses, order timestamps, and contact information submitted through our order forms for fraud prevention, order verification, and service security.
- By submitting an order, you acknowledge this data collection.
- We do not sell or share your personal information with third parties except as required by law or for payment processing purposes.

10. Disputes & Resolution
- Any disputes arising from these Terms or our services will be resolved through binding arbitration in Denton County, Texas, or through small claims court.
- Client waives the right to participate in class action lawsuits against Company.
11. Modifications
- We reserve the right to modify these Terms & Conditions at any time.
- Updated Terms will be posted on our website with a new "Last Updated" date.
- Continued use of our services after modifications constitutes acceptance of the updated Terms.
12. Governing Law
- These Terms & Conditions are governed by and construed in accordance with the laws of the State of Texas.
Agreement & Acceptance
By submitting an order form, making payment, or accepting installation, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
